What is Right to Buy?

Right to Buy is a government scheme for social tenants, whose landlord is a public sector body such as a local council. It gives tenants who have been living in their council property longer than 3 years the ability to buy their home from the council at a discounted price. The longer you have lived in the property, the higher the discount can be.


What do Conveyancers do for Right to Buy?

How long does Right to Buy take?

Since Right To Buy relies on the capacity of your local council and various application stages, it can be a much longer process than purchasing a property privately, lasting anywhere between 3 to 12 months. Your landlord needs to reply within 4 weeks of you first applying for Right To Buy, you then have 12 weeks after receiving the offer to say you still wish to buy the property. After that, you have 3 months to tell your landlord if you believe the property price is too high. And if a new price is valued, you have another 12 weeks to accept that too.

All this takes place before conveyancing even begins, so it will very much depend on how quickly you act, and how quickly your landlord responds.


What discount do I get with Right To Buy?

The discount on purchasing your council property will depend on where you are in the country, how long you have lived in the property, what kind of property it is and how much it is worth.

Right to Buy House Discount

If you are purchasing a house through Right To Buy, you’ll get a 35% discount if you’ve been a tenant in the property for 3 -5 years. After 5 years, your discount will go up by 1%, up to the maximum amount, for each extra year you live in the property.

Right to Buy Flat Discount

If you are purchasing a flat or apartment through Right To Buy, you’ll get a 50% discount if you’ve been a tenant in the property for 3 – 5 years. After 5 years, the discount will up by 2% for every extra year you stay in the property.

What is the maximum discount on Right to Buy?

The maximum discount you can get on your council property will be whichever of the following options is lower:

  1. 70% of the value of the property
  2. The maximum discount for your region

Am I eligible for Right to Buy?

In order to be eligible to buy your council property, the following crteria must apply:

  • You are a secure tenant in the property you want to buy
  • You have been a tenant of a council or public sector landlord for at least 3 years total
  • The property you’re buying is your only/main home
  • You have not breached the conditions of your tenancy or have a suspended possession order against you
